Why are there no unfinished buildings in Australia? Just Just because there are strict precautions!

In Australia, developers are subject to strict laws and regulations. Usually, bank loans can only be approved when more than 70% of the buildings are sold. If the sales standards are not met, the loans cannot be approved. When there is no financial support, the houses will not start construction at all. Naturally, there will be no unfinished buildings.

The Sunset Clause

Furthermore, there is a clause in any contract to buy a house in Australia, called Sunset Clause.

In Australia, when the house is purchased, there is generally no specific time for the house to be delivered in the contract, but the contract would specify a sunset date. If the house cannot be delivered before the time, the buyer and seller can terminate the contract.



With this Sunset Clause, if the developer is unable to deliver the house at the latest time due to capital, construction process and other reasons, the buyer can get back the down payment to avoid an indefinite waiting for the house. We provide houses for sale in South Australia.

On termination of contract

The intention of the Sunset Clause is to give the buyer and seller a relatively definite time limit to be bound by the contract. In order to guarantee the legitimate rights and interests of the buyer, the relevant government departments of New South Wales issued a new decree in November 2015, which put forward a new requirement for the seller to terminate the contract according to the provisions of Sunset Clauses:

? If the seller wants to terminate the contract, he/she must give the buyer at least 28 days prior written notice;

? The above notice must specify the seller's intention to terminate the contract and the reasons;



The contract shall be terminated with the consent of the buyer. If the buyer does not agree or does not give a clear reply, the seller must obtain a court order from the Australian high court to continue to terminate the contract.

In considering the seller's claim to terminate the contract, the high court of Australia will consider factors including but not limited to:

? The terms and provisions of the contract itself;

? Whether it is reasonable for the seller to terminate the contract;

? Reasons why the seller fails to deliver the house on time or delays the delivery;

? Whether the market value of the property sold has risen;

? The effect of termination of the contract on the buyer;

? Other matters which the court deems relevant;

It can be seen from the detailed rules of the new act that the seller shall not unilaterally terminate the contract with Sunset Clauses. If the seller wants to terminate the contract, it needs to prove that the delayed delivery is caused by its own force majeure.

No matter the strict loan approval process or sunset clauses, the mature legal mechanism of the Australian real estate market ensures that the unfinished buildings will not appear. The new law on Sunset Clauses regulates the cancellation of contracts by developers, providing more legal protection for investors in forward housing.
